RE: Pension Lawsuit Update
MTS Allstream filed a Notice of Appeal of the Court of Queen’s Bench judgment of January 19th, wherein plan members were awarded approximately $100 million dollars to improve pension benefits, and governance of how these funds will be utilized. In response, on April 22, 2010, TEAM in conjunction with the other plaintiffs filed a Notice of Cross Appeal with respect to the Court’s other determination concerning control over future surpluses in the plan and protection of future accrual of benefits.
Fortunately, MTS Allstream’s recent decision to change law firms has not resulted in any delay in the three day appeal hearing scheduled to begin on December 6, 2010. I will advise you of the time and courtroom when they are available.
