Re: Pension Lawsuit Update
It has taken a long time to get here, but on the day after Labour Day, September 2, 2008, the main part of the pension lawsuit TEAM et al v. MTS et al - Queen’s Bench File No. CI 99-01-14589 finally goes to trial. A decade of union dues, retirees’ voluntary contributions, extensive legal activity, preparation, and commitment were required to get to this point.
The trial judge, Justice Bryk, heard Mr. Harry Restall’s evidence during the weeks of April 28th, May 5th and June 2nd. Mr. Restall, a former MTS employee, now in his 70’s, did extremely well on the stand in both direct and cross-examination. Our counsel reported that they were very pleased with his testimony, and that the hearing went better than expected.
The trial is scheduled September 2, 2008 to November 7, 2008, starting at 10:00 a.m. September 2nd in Courtroom 128, Law Courts Building, 408 York Avenue, Winnipeg. A calendar of the next three months showing tentative witness examination dates is available on request from the TEAM office.
